In Whose Interests: Evaluating Attorney Fee Awards and Contingent-Fee Agreements in Social Security Disability Benefit Cases

Abstract

This article evaluates the tests that have emerged for court awards of attorneys' fees in retroactive disability benefits cases and focuses particularly on cases involving contingent-fee agreements between successful claimants and their counsel. As background, the article surveys the statutory and regulatory scheme governing the administration of federal disability insurance and welfare benefits.
